Labor Condition Application for H-1B Nonimmigrants
ETA Form 9035:

Form 9035 is required to be filed with the US DOL PRIOR to a foreign worker beginning an assignment. The employer must demonstrate that they have made a good faith effort to fill a position with local workers. The date shown is the date the document was signed.

If you or someone you know fits the job title shown in one of the forms AND you are available, you should contact IBM using the Employer Telephone # shown on the form, OR the contact information listed (many times the contact information section is left blank). If you are told there is no opening available OR you are refused consideration, contact the Department Of Labor immediately and file a complaint.

Note: There are two versions of ETA Form 9035. One version has an "Employer Control Number" and the other has a "Page Link Number". They are arranged differently, but they contain essentially the same information. Both forms are supposed to be displayed at the place of employment PRIOR to the start date of the assignment to provide advance notice to United States employees.
